(Quantifying the academic teaching load in conventional hours - from the perspective of the special law and the general regulatory framework)
Abstract
Durata muncii unui cadru didactic universitar este conventionala, deoarece norma didactica trebuie exprimata legal, numai in ore conventionale. Numarul maxim de ore medii saptamanale conventionale este de 16. Acesta este nivelul maxim al obligatiilor aferente unui contract individual de munca al unui cadru didactic universitar, la care nu se mai poate adauga altceva, decat sub rezerva respectarii regimului muncii suplimentare. Cuantificarea mentionata trebuie sa se reflecte corespunzator in contractele de munca, in fisele de post si in statele de functii, care vor specifica adecvat toate activitatile desfasurate de cadrul didactic. Obligatiile de cercetare se includ si ele in norma didactica de 16 ore conventionale pe saptamana, neconfundandu-se cu norma de cercetare la care se refera alin. (1) lit. b) al art. 287 din Legea nr. 1/2011; in consecinta nu se pot adauga la limita mentionata. Timpul de munca conventional mediu pe saptamana al unui cadru didactic incadrat cu norma intreaga, de 16 ore conventionale, potrivit legii speciale, este echivalent celui de 40 de ore fizice pe saptamana potrivit Codului muncii. Acesta este si sensul alin. (22) al art. 287 din primul act normativ: "Suma totala a orelor de munca dintr-o norma didactica sau de cercetare, realizata prin cumularea ponderilor activitatilor prevazute la alin. (1), este de 40 ore pe saptamana". In practica, dispozitiile de mai sus sunt interpretate in sensul ca un cadru didactic ar fi obligat sa presteze 40 de ore fizice pe saptamana. Vom arata ca este vorba de o interpretare eronata, chiar daca este generalizata. Interpretarea sistemica, interpretarea gramaticala si reducerea la absurd constituie metode de interpretare care vor demonstra acest punct de vedere. In contextul creat de obligatia tuturor persoanelor care-si desfasoara activitatea in cadrul unor proiecte pe fonduri structurale (in special in cadrul POSDRU) de a completa pontajul de activitate, care sa reflecte intreaga activitate profesionala zilnica, pentru a se putea monitoriza respectarea unor limite zilnice de lucru impuse de catre finantator (chiar daca ele nu exista in legislatia nationala), problema timpului de lucru al cadrelor didactice universitare, aferent unei contract individual de munca, este una cu atat mai importanta. Situatia este aplicabila in egala masura proiectelor de cercetare desfasurate in cadrul universitatilor. De aceea, se impune eliminarea pontajelor cu 8 ore/zi de salariat, respectiv 40 de ore pe saptamana si indicare maximului de 16 ore saptamanale conventionale, respectiv mentionarea in toate pontajele aferente proiectelor POSDRU si altor categorii de proiecte doar a orelor conventionale aferente normei didactice - pentru activitatea universitara.

Duration of working hours for an academic professor is a conventional one, as teaching workload must be legally expressed only in conventional hours. The maximum average number of weekly conventional hours is 16. This is the maximum level of obligations related to an individual labor contract for an academic, to which nothing else can be added, if additional work is not taken into discussion. The above-mentioned quantification must be reflected properly under the labor contracts, job descriptions and under functions’ list, under which all the activities carried out by the academic staff will be appropriately stipulated. Research obligations shall be also included into the teaching conventional workload of 16 hours per week, and it must not be mistaken for the research workload referred to into paragraph (1) letter (b) of Article 287 of the Romanian Law No 1/2011; therefore such research obligations cannot be added to the above-mentioned limit. Conventional average working hours per week for an academic employed on a fulltime basis, of 16 conventional hours, according to the law, is equivalent to that of 40 hours per week according to Romanian Labor Code. This is the meaning of paragraph (22) of Article 287 of the Romanian Law No 1/2011: „The total amount of working hours for academic teaching or research workload carried out by adding the weights of activities referred to under paragraph (1), is of 40 hours per week". In practice, the above-mentioned provisions shall be interpreted in the sense that an academic would be obliged to perform 40 physical hours per week. Hereunder we will point out that this is a misinterpretation, even if it is a generalized practice. Systemic interpretation, grammatical interpretation and proof by contradiction are methods of interpretation that were used to demonstrate this point of view. Due to the fact that all persons who carry out their activity in projects on structural funds (in particular in POSDRU projects) have the obligation to record their activity on timesheets, which reflects the entire daily professional activity, in order to monitor compliance with daily working limits imposed by the financing party (even if they are not stipulated under the national law), the matter of the working time of academics related to an individual labor contract is even more one of utter importance. The situation is equally applicable to research projects carried out in universities. Therefore, it is advisable to eliminate the timesheets of 8 hours per day for each employee, i.e. 40 hours per week, and to indicate the maximum conventional weekly 16 hours, respectively to stipulate under all timesheets related to POSDRU projects and other types of projects only the conventional hours related to academic workload – for the university activity.
